Criminal Charges Avoided
The owner of a fleet of vessels was facing several criminal charges over the company’s Safety Management System Manuals with fines of $250,000 and possible jail time for Directors.
Shorlink reviewed the case including video footage, witness statements and the evidence presented by the government Inspector.
Upon reviewing, the Shorlink Expert Witness Statement the prosecutor dropped all charges and no convictions were recorded.
A Culture of Compliance
Shorlink have been managing all the on-water safety for a major commercial fishing company for 3 years now.

Our Systems Prevent Legal Action
A fishing company Shorlink have managed the onboard safety for several years, has, like most maritime companies had a crew member lodge an injury complaint. Stating he was injured due to not being inducted and received no training.
This case was dropped due to the evidence Shorlink we able to provide.
As we conducted the inductions and delivered the training Shorlink had all the document trail to prove his statements were false.
This is one of the companies we develop the Safety Management System for, do the inductions and deliver the training which is all fully documented.
Fire in the Engine Room
Another case was where we do the safety management for and deliver their onboard crew training.
Part of the training we provide is fire response which turned out to be valuable.
A situation arose where 2 contractors were doing hot work (welding) in the engine room which ignited a fire. One of the crew members Shorlink had been training responded immediately to extinguish the fire and save the vessel from major damage.
He later said that it was because of the confidence he had from the Shorlink training, that allowed him to assess the situation and to take the appropriate actions.
All Clear by the Water Police
Whilst out on a charter we were boarded by the Water Police who undertook an assessment of our SMS and other documents.
As we did not have all documents onboard they issued an infringement notice and advised that they would be attending our office during the next week to inspect the SMS and sewage management plan.
We contacted Shorlink for advice as they had provided our vessel SMS manuals, Hire & Drive SMS manual and sewage management plan.
Their principal consultant Wayne Linklater went through the infringement notice in detail and ensured all of our documentation was up to date. This included the sewage management plan as we had altered the system since it was originally installed.
When the Water Police inspected our documents, they said they were very good, and no changes would be required.
The service Shorlink provided was excellent and helped us avoid any fines or other penalties. They have provided ongoing consultation services to assist us in ensuring our operations comply with all the requirements.
Injury Litigation Avoided
When our company received a civil injury claim we were worried about the potential consequences. We had a crew member fall down a hold and sustained injuries. As Shorlink was our SMS supplier we contacted them to see if they could help.
We were pleased to discover that they handle this sort of thing on a regular basis, so we engaged them to handle the case for us. They meet with our lawyers and then undertook an internal investigation for us.
When AMSA audited our SMS Manuals they were very happy with them and were of the opinion that the procedures covered all the requirements relative to the incident.
We found that Shorlink’s internal investigation was extremely thorough and identified that the crew member failed to comply with company policies and did not follow procedures.
The SMS manuals and investigation report along with Wayne’s expert witness statement saved the company significant costs in fines and related expenses.
